习近平法治思想中的立法思想研究

中央全面依法治国工作会议确立了习近平法治思想在全面依法治国过程中的重要地位和作用。立法工作作为法治系统工程中的重要一环,也是习近平法治思想中的重要组成部分。习近平有关立法思想的形成,离不开对既往立法工作的总结和当下改革开放的实践,也离不开全面从严管党治党的经验和对世界未来发展趋势的思考。习近平法治思想中的“坚持党对全面依法治国的领导”“坚持以人民为中心”“坚持中国特色社会主义法治道路”是对法治工作的要求,自然也是对立法工作的要求。在未来的立法中,应进一步加强党内法规制度研究,厘清中央和地方的立法权限划分,处理好改革和法治之间的关系,并加强涉外法治研究。

The Central Conference on comprehensively advancing rule of law established the important position and role of Xi Jinping Thought on the Rule of law in the process of comprehensively advancing rule of law.As an important part of the rule of law system,legislative work is also an important part of Xi Jinping Thought on the Rule of law.The legislative thought in Xi Jinping Thought on the Rule of law is formed in the summary of previous legislative work and in the practice of reform and opening up.It is also formed on the basis of comprehensively thinking about managing the party strictly and the future development trend of the world.In Xi Jinping Thought on the Rule of law,"adhering to The CCP'S leadership over China's overall rule of law","taking the people as the center"and"adhering to the socialist rule of law with Chinese characteristics"are the requirements for the rule of law,and naturally,they are also required for legislative work.In the future legislation,we should further strengthen the study of intra-party regulations,clarify the division of legislative authority between the central and local governments,handle the relationship between reform and the rule of law,and strengthen the study of foreign-related rule of law.
