摘要
我国非法“外教”问题已形成由非法“外教”、外教中介和教育机构组成的黑色产业链。在教育机构与中介机构的“共谋行为”下,非法“外教”现象普遍,成为扰乱社会治安的危害因素。从利益相关者视角分析,非法“外教”产业链紧密联结成利益共同体,法律规制漏洞、监管部门治理合力不足、社会力量治理意愿薄弱等导致非法“外教”问题的治理陷入了“发现难”“取证难”“定性难”的困境。应通过健全法律法规、整合监管资源、充分动员社会力量、建立评价机制等措施凝聚“立法-执法-社会”治理合力,构建非法“外教”问题的协同治理格局。
Under the“collusion”of educational institutions and intermediary agencies which are in the black industrial chain of“illegal foreign teachers”in China,“illegal foreign teachers”are common and harmful to social order.From the perspective of stakeholders,interest community consisted of“illegal foreign teachers”industrial chain,loopholes in legal regulation,lack of joint governance of regulatory authorities,and weak governance will of social forces lead to the dilemma of governance which are“difficult to find”,“difficult to obtain evidence”and“difficult to determine nature”.We should improve laws and regulations,integrate regulatory resources,fully mobilize social forces,establish evaluation mechanisms to gather the governance force,and build a collaborative governance pattern.
