我国铁路行业生态环境保护法律法规及制度体系现状研究

Study on the Current Situation of Laws,Regulations and Institutions System of Ecological Environment Protection in China's Railway Industry

从法律、行政法规和部门规章3个方面阐述我国铁路生态环境保护法律法规体系,从环境影响评价制度、公众参与制度、环境监理制度、“三同时”制度、竣工环境保护验收制度等阐明我国铁路生态环境保护制度体系。针对目前我国铁路行业生态环境保护法律法规及制度体系存在的问题提出相应的对策及建议,即修订完善铁路行业相关环境保护法律法规、健全我国铁路环境保护部门规章构建体系、加强铁路行业环境影响评价工作顶层设计、确立建设项目环境监理制度法律地位等,为促进我国铁路行业的高质量发展提供借鉴。

The laws and regulations system of railway ecological environment protection in China are expounded from three aspects:laws,administrative regulations and departmental rules,and the system of railway ecological environment protection in China is expounded from the aspects of environmental impact assessment system,public participation system,environmental supervision system,"three simultaneities"system and environmental protection acceptance system after completion.In view of the problems existing in the laws,regulations and institutional systems of ecological environmental protection in China's railway industry,this paper puts forward corresponding countermeasures and suggestions,namely,revising and perfecting the railway environmental protection laws and regulations,improving the regulation construction system of China's railway environmental protection department,strengthening the top-level design of environmental impact assessment,and establishing the legal status of environmental supervision system for construction projects,etc.,so as to provide reference for promoting the high-quality development of China's railway industry.
