中国计量法治完善研究——以《计量法》的修订为核心

Study on the perfection of the rule of Metrology Law

目的:研究以《计量法》修订为核心的计量法治完善思路。方法:运用实证研究的方法对全国31个省市自治区进行了调研,并运用文献研究法思考计量法治的完善路径。结果:作为助力实现质量强国目标的基础法律制度,《计量法》施行三十余年,滞后性明显,因此《计量法》急需修订。计量法治完善要与建立现代化计量治理体系相结合,处理好七个方面的关系。建议改革计量法中的行政许可制度,只保留标准考核这一项行政许可,不再将型式批准、计量授权和资质认定作为行政许可事项。结论:《计量法》修订要变革行政许可制度,高度关注民生,体现量子化变革需要并与国际接轨,实现计量法治的完善。

Aims:This paper aims to give some sugguestions for the improvement of the rule of Metrology Law with regard to its revision.Methods:The study firstly adopted the method of empirical research to make a national survey to sort out the perfection route with the method of literature research.Results:As a basic legal system to promote the implementation of Quality Power Strategy,China’s Metrology Law has been formulated for about 30 years.However,with the shortcoming of hysteresis,the Law is in urgent need of revision.The revision should be based on building a modern metrological governance system.In addition,the revision should deal with the relationships among seven aspects.In the Metrology Law,the Administrative Licensing System should be revised and only standard inspection can be retained.In addition,type approval,metrological authorization and qualification accreditation are not to be retained.Conclusions:The revision of Metrology Law should be combined with the reform of the Administrative Licensing System;and more attention should be paid to people’s livelihood,to the need of quantum revolution,and to the link to international standards.
