跨国网络活动效果管辖原则适用问题研究

Application of Effect Principle in Transnational Internet Cases

网络活动的日益广泛深入让各国认识到网络管辖权的重要性,纷纷提出网络主权和数据主权的主张,并且通过立法、司法扩大对网络空间的管辖权。跨国网络活动对传统管辖权理论带来一定的冲击与挑战,管辖权冲突加剧,在这种情况下,国际法律实践普遍采用了效果原则确定管辖权归属。效果原则源于客观属地管辖权,强调行为在领域内产生的影响或效果,因此适应跨国网络活动的特点,对解决管辖权归属问题具有重要意义,但是其合法性基础、适用标准、合理限制等都需要认真细致地研究,以期对我国在主张域外网络空间管辖权方面提供理论参考及对策建议。

By the increasing breadth and depth of internet activities many states realize the importance of internet jurisdiction and claimsovereignty on the internet and data,and expand their internet jurisdictionthrough legislation and judicature.Transnational internet activities have brought impact and challenge to the traditional jurisdiction theory,and the conflict of jurisdiction has intensified.Under this circumstance,the effect principle is generally adopted in international legal practice to determine the jurisdiction.The effect principle derives from the objective territotry jurisdiction and emphasizes the influence or effect of the behavior in the domain.Therefore,it is of great significance to adapt to the characteristics of transnational internet activities and solve the problem of jurisdiction.However,its legal basis,applicable standards and reasonable restrictions all need to be carefully studied,so that It is expected to provide theoretical reference and countermeasures for China in asserting extraterritorial jurisdiction on internet.
