摘要
外包的概念在劳动法中并没有明确定义,实践中外包与劳务派遣之间界限比较模糊,容易引发纠纷,不利于劳资和谐。本文从劳动法的视角对外包的合规管理内容进行分析,并通过相关案例探讨了劳务派遣与外包之间的界限,对企业外包管理提出几点具体建议。
The concept of outsourcing is not clearly defined in the labor law.In practice,the boundary between outsourcing and labor dispatch is blurred,which is prone to disputes and is not conducive to harmonious labor-capital relations.The article analyzes the content of compliance management of outsourcing from the perspective of labor law,and discusses the boundary between labor dispatch and outsourcing through relevant cases,and puts forward several suggestions for enterprise outsourcing management.
