市场经济条件下经济法的价值取向--以小产权房为例

The Value Orientation of Economic Law under the Condition of Market Economy--A Case Study of Small Property Right Houses

经济法的价值,是经济法研究领域的核心之处,是指导经济法实践和市场经济发展的基石。随着城镇化进程的加快,许多城市和周边农村分界中所存在的“小产权房”愈演愈烈,这是与我国国土部门土地改革以及房地产市场经济前景有所关联的一大棘手问题。新《土地管理法》的改变引发了人们关于“小产权房”的再度讨论。本研究以“小产权房”为例,剖析经济法的根本价值,即追求社会整体公共利益、维护市场经济持续发展。

The value of economic law is the core of the research field of economic law and the cornerstone for guiding the practice of economic law and the development of market economy.With the acceleration of urbanization,the“small property right houses”existing in the boundary between many cities and surrounding rural areas has intensified,which is a thorny issue related to the land reform and the economic prospects of the real estate market in China.The changes in the new Land Management Law have triggered renewed discussions on“small property rights houses”.This study takes the“small property right houses”as an example to analyze the essential value of economic law,namely,to pursue the overall public interest of society and maintain the sustainable development of the market economy.
