国家公园资源环境综合执法现状分析与展望

为落实生态文明体制改革目标,基于国家公园全民公益性优先的基本要求,亟须对国家公园资源环境综合执法在实体权限的分配、程序上的合法规范行使展开深入剖析。分析表明,目前存在执法主体不统一、权限分配不明、综合执法队伍编制不统一、行政执法与刑事司法之间缺乏有效衔接等问题。在我国国家公园"统一事权、分级管理"的总体管理体制下,资源环境综合执法应该统一由相应国家公园管理局内设综合执法大队行使,而不应当由所在市县综合执法大队派驻。资源环境综合执法职责的分配和规范行使,应当由各个国家公园所出台的具体细则作出具体规定。

National park is the key physical entity of national ecological security system in the future.Under the dual background of ecological civilization system reform and national park pilot reform, it has certain theoretical value and practical significance to study the comprehensive law enforcement of national park resources and environment in China.Based on the strict ecological protection requirements of national parks, in order to achieve the goal of giving priority to the public welfare, it is necessary to conduct in-depth analysis on the generation and distribution of comprehensive law enforcement of resources and environment in national parks in the entity and the legal and normative exercise in procedures.At present, national parks are faced with some practical problems, such as the subject of law enforcement is not unified, the distribution of authority is unclear, the establishment of comprehensive law enforcement team of resources and environment is not unified, the comprehensive environmental law enforcement mechanism is not smooth, and the lack of effective connection between administrative law enforcement and criminal justice.At present, the law enforcement power of national parks should not be managed by local government, but by the national parks.The distribution and standardized exercise of the comprehensive law enforcement authority of resources and environment should be specified in the "One Park One Regulation One Detailed Rule" issued by each national park.
