In the context of human biobank,as a constraint and incentive institutional arrangement,the ownership of intellectual property rights and the benefit sharing system,to some extent,can coordinate the different interests and needs of all relevant stakeholders which including human biobanks,genetic sample donors,researchers and so on.To promote public health welfare and the innovation ability in the life science and technology field,in the operation of human biobank,it is necessary to strengthen communication and coordination among all relevant stakeholders gradually,and explore the rational,adaptable and hierarchical pathways,then to builed the policy on access to and uses of human genetic samples and data with intellectual property and benefit sharing system as the axis.
