国际体育仲裁院反兴奋剂庭仲裁机制研究

Arbitration Mechanism of Anti-Doping Division of Court of Arbitration for Sport

运用比较分析法、案例分析法等方法,对ADD规则下的反兴奋剂仲裁机制进行研究,分析反兴奋剂庭仲裁流程、基本定位、管辖权、仲裁员和奥运会相关的兴奋剂纠纷解决,并总结其仲裁机制独立性、公正性、效率和成本等方面的积极作用和存在的问题。反兴奋剂庭相对独立于CAS,通过程序上的设计可以促进兴奋剂纠纷的高效解决,但其也存在仲裁员中立性不足、裁决时限不确定和法律救济成本较高等问题。以此为鉴,我国体育仲裁可以设立独立的仲裁庭专门审理案件,同时结合我国国情和体育发展实际,进一步完善体育仲裁机制。

With the research methods of comparative analysis and case analysis,the paper studies the anti-doping arbitration mechanism under the ADD rules and analyzed the arbitration process,basic positioning,jurisdiction,arbitrators and the anti-doping cases related with the Olympic Games.The paper summarizes the positive role and problems in its independence,impartiality,efficiency and cost.The procedural design of the ADA relatively independent of the CAS can facilitate the efficient resolution of doping disputes,but it also has the problems of lack of arbitrator neutrality,uncertain time limit and higher cost of legal relief.China's sports arbitration can set up an independent arbitration tribunal to treat cases,and at the same time further improve the sports arbitration mechanism based on China's national conditions and the actual situation of sports development.
