农村土地承包经营权继承问题研究及规则指引

现行法律规范在农村土地承包经营权继承问题上的模糊规定引起了学界的颇多争议,家庭承包方式取得的土地承包经营权是具有双重属性的特殊用益物权,复杂的权属性质加大了判断其能否继承的难度。本文在相关立法规定的基础上分析农村承包经营权是否具有可继承性,进而提出符合实际的规则指引。

The vague provisions of the current legal norms on the inheritance of rural land contracting have caused a lot of dis⁃putes in the academic circles.The land contractual management right obtained by family contracting is a special usufructuary right with dual attributes,and the complex nature increases the difficulty of judging whether it can be inherited.On the basis of the relevant legislative provisions,this paper analyzes whether the right of rural contracted management is inheritable,and then puts forward the practical rules and guidelines.
