建筑工程中“不可抗力”的风险分担

Risk Sharing of"Force Majeure Clause"in Architectural Engineering

建筑工程施工中时刻伴随着“不可抗力”产生的风险,经常造成严重的经济损失。因此,在建筑施工中,要想避免因“不可抗力”造成的风险,就必须重视对其的分析和应对。此外,在处理“不可抗力”风险的过程中,要以签订的合同为基础,重视风险管理,制订相应的应急措施;购买工程保险,可以减少“不可抗力”带来的风险损失。论文就建筑工程中“不可抗力”的概念解读为切入点,提出了“不可抗力”风险的分担策略,并结合实际工程案例,提出对工程中“不可抗力”风险承担的思考,将风险转化为更大的经济利益。

The risk of"force majeure"is always accompanied by serious economic loss in construction.Therefore,in architectural engineering,in order to avoid the risk caused by"force majeure",we must pay attention to the analysis and response of"force majeure"risk.In addition,in the process of dealing with the risk of"force majeure",we should pay attention to risk management and formulate corresponding emergency coping measures on the basis of the signed contract,and purchase engineering insurance can reduce the risk loss caused by"force majeure".In this paper,the concept of"force majeure"in construction engineering is interpreted as the starting point,the coping strategy of"force majeure"risk sharing is put forward,and the thinking of"force majeure"risk bearing in engineering is put forward in combination with actual engineering cases,so as to turn risk into greater economic benefits.
