摘要
新修订的《档案法》对档案的收集、形成、保护、利用等环节均进行完善,扩大、保障档案利用是最大亮点。《档案法》的修订,必然对如何有效利用司法机关的诉讼档案产生深远影响。诉讼档案的教学科研价值,使高校对诉讼档案有强烈需求和真实需要,模拟法庭是高校法学教育利用诉讼档案的主要方式。为贯彻落实新《档案法》,充分发挥诉讼档案的价值和作用,建议及时修订诉讼档案管理办法,扩大诉讼档案的利用范围、放宽利用条件、简化利用手续等。
The newly revised Archives Law has improved the collection,formation,protection,and utilization of archives.The biggest highlight is the expansion and protection of archives utilization.The revision of Archives Law will inevitably have a profound impact on how to effectively use the litigation archives of judicial organs.The teaching and scientific research value of litigation archives makes colleges and universities have a strong and real need for litigation archives.Moot court is the main way for university law education to use litigation archives.In order to implement the new Archives Law and give full play to the value and role of litigation archives,it is recommended that litigation archives management measures be revised in a timely manner to expand the scope of litigation archives utilization,extend the utilization conditions,and simplify the utilization procedures.
