地方立法与保护民间记忆遗产——以《广东省侨批档案保护管理办法》为例

Local Legislation and the Protection of Folk Memory Heritage

记忆遗产在传承地域、族群、国家的历史文化记忆、弘扬优秀传统文化方面具有不可替代的独特作用。书写时代的民众日常生活中产生了包括侨批在内的大量重要民间记忆遗产,因其保藏生态环境的脆弱,亟需立法保护。2018年1月,国内首部保护民间记忆遗产的地方法规《广东省侨批档案保护管理办法》颁布,并于3月起正式实施。通过分析立法过程中对于其可行性与必要性、立法重点难点的考量和把握,探究立法效果,揭示此一立法实践对其他重要民间记忆遗产的保护借鉴和启示意义。

Memory heritage plays an irreplaceable and unique role in inheriting the historical and cultural memory of regions,ethnic groups and countries and in carrying forward excellent traditional cultures.A large number of important folk memory items,including remittance mail by overseas Chinese,were produced in the daily life of the people in the handwriting era.Because of their fragile ecological environment for conservation,legislation is urgently needed.“Measures for the Protection and Management of Remittance Mail by Overseas Chinese”,the first regional regulation on the protection of folk memory heritage in China,was promulgated by Guangdong provincial government in January 2018,and put into effect in March the same year.This paper analyzes the consideration and grasp of the feasibility,necessity,key points and difficulties of the legislation in the legislative process,explores the legislative effect,and reveals the reference value and implications of this legislative practice for the protection of other important folk memory heritage.
