儿童网络游戏伤害与保护研究

Research on children’s online game injury and its protection

当前网络游戏全面入侵了儿童的生活世界,对其身心成长和学业发展带来了诸多负面影响,儿童网络游戏伤害已成为广受关注的社会问题。受资本逐利的驱动,网络游戏趋向于单向度追求利润最大化从而彰显其“原罪”,但在现代社会和市场经济情境中,基于儿童拥有网络游戏权利的理念,取缔网络游戏产业或简单禁止儿童接触网络游戏都不应是治理选项。社会应提供坚实保护以使儿童免于网络游戏伤害。我国已颁布实施多项儿童网络游戏保护政策,但政策理念上重在事后惩罚,且没能有效区隔出儿童网络游戏空间,实践相关保护政策法律效力不足。基于已有保护政策和教育实践中所存在的问题,完善儿童网络游戏伤害保护体系应提升相关立法层级,强化研发保护程序,落实家长引导,学校教育要“堵疏并重”为之提供形式与实质双重保障。

Nowadays,online games have comprehensively invaded the living world of children in China,and have brought many negative effects on their physical and mental growth,and their academic development.Children’s injury from online games has undoubtedly become a serious social problem.Driven by profit-seeking capital,online games tend to pursue one-sided profit maximization,thus revealing its“original sin”.However,in the context of modern society and market economy,and based on the idea that children have the right to play online games,neither the ban on the online game industry nor the prohibition of children’s access to online games should be governance options.Our society should provide solid protection for children so as to protect them from the harm of online games.China has promulgated and implemented a number of protection policies for children’s online games,but in concept,they emphasize on after-the-fact punishment and fail to distinguish children’s online game space.In practice,the legal effect of relevant protection policies is insufficient.Therefore,the protection system for children’s online games should be improved by upgrading the level of relevant legislation,strengthening research and development of protective software,and implementing parental guidance.Meanwhile,school education should attach equal importance to dredging and blocking,providing both formal and substantive protection for children.
