Human Emancipation and the Value of Human Rights in Socialism with Chinese Characteristics

马克思批判了资本主义自由权的局限性和政治权的虚伪性,但是仍然肯定了人权在推动政治解放和促进人的解放中的作用。人权的存在及作用取决于历史条件,如果人类社会还没有实现人的解放,人权就会存在并发挥作用;人的解放是社会不再需要人权、人权逐步消失的自然过程。社会主义中国建立在人权观念和制度没有充分发展的历史基础之上,人权阶段是不可逾越的历史阶段。中国特色社会主义人权只有置于人的解放的视域中才能准确界定其价值。其价值内核是促进人的自由全面发展,其具体形态取决于社会主义和中国这两个基本规定性,表现为和谐的自主、公共的个体、深刻的平等、普遍的特殊、有形的实质、整体的发展等方面。
