区块链等金融科技的兴起推着互联网金融加速革新。农业众筹作为互联网金融在农业领域的一种实践创新,具有金融补充、产消合一、资源整合的理想功能,但其现实发展受制于信任、安全等方面的风险,存在市场信任度不高、融资规模偏小、运行专业化不足等问题。而区块链技术的核心价值在于解决信任和安全问题,故区块链技术应用的嵌入有利于化解农业众筹现实困厄、优化农业众筹运行流程。但在推进“区块链+农业众筹”融合创新的同时,必须注意防范技术安全隐患可能导致的系统性风险、相关法律风险等。因此,对其加强法治监管势在必行,在法治监管进路上,建议引入“监管沙盒”,平衡创新激励与法律规制;强化功能性监管,兼顾平台管理和业务监督;采用区块链节点监管,协同规则治理和技术自治。

The rise of financial technology such as blockchain is accelerating the innovation of Internet finance.As a practical innovation of Internet finance in the agricultural field,agricultural crowdfunding has the ideal functions of financial supplementation,integration of production and consumption,and resource integration.However,its actual development is subject to risks in trust and security,and problems such as low market trust,small financing scale and insufficient operation specialization.The core value of blockchain technology lies in the solution to the problem of trust and security.So the embedding of blockchain technology applications is conducive to resolving the difficulties of agricultural crowdfunding and optimizing the operation process of agricultural crowdfunding.However,while advancing the integration and innovation of“blockchain+agricultural crowdfunding”,attention must be paid to preventing systemic risks and related legal risks that may be caused by technical security risks.Therefore,it is imperative to strengthen the rule of law in its application.On the way to the rule of law,it is recommended to introduce a“supervisory sandbox”to balance innovation incentives and legal regulations,strengthen functional supervision,take into account both platform management and business supervision,adopt blockchain nodes supervision and coordinate rule governance and technological autonomy.
