新时代总体国家安全的刑法域外保障理念研究

Research on Concept of Extraterritorial Protection of Criminal Law for Overall National Security in the New Era

随着国际发展环境的不断变化,我国新时代总体国家安全观拓展出新的内涵。我国未来发展不仅需要国内环境安全稳定,也需要外部环境的有力支撑。近年来,大国间竞争不断加剧,部分西方国家将国内法律的域外适用作为对外保障本国发展利益的重要手段。特别是最具强制力的刑法从幕后走到台前,成为保障一国发展利益的法律武器。因此,我国刑法应相时而变,进一步强化域外保障理念。通过完善刑事立法、增加涉外执法和司法实践,合理扩大我国刑法对涉外犯罪主体、危害我国国家安全犯罪及国际犯罪的管辖权,充分发挥我国刑法对外国刑事公权力的阻断效力和对具有涉外因素犯罪行为的域外效力,以维护我国外部发展环境,保障我国发展利益。

With the continuous change of external development environment,the overall national security concept of our country develops new connotation in the new era.The future development of China needs not only the security and stability in domestic environment,but also the strong support of external environment.In recent years,competition among the great powers has been intensifying,so some western countries take the extraterritorial application of domestic laws as important means to protect their own interests.In particular,the most forceful criminal law moves from behind the scenes to the front stage,becoming an effective legal weapon to protect the interests of certain country.Therefore,China’s criminal law should make adjustment accordingly and further strengthen the concept of extraterritorial safeguarding.Through improving criminal legislation,increasing foreign-related law enforcement and judicial practice,appropriately expand the jurisdiction of China’s criminal law on the subject of foreign-related crimes,national security crimes and international crimes,we should give full play to the blocking effect of China’s criminal law to foreign criminal public power and the extraterritorial effect to crimes with foreign-related factors,so as to maintain the external development environment of our country and protect the rights and interests of national development.
