在现代社会,行政主体在管理国家事务时,与民事法律行为及权利“相遇”的情形越来越多。王某诉四川鸿天房地产公司商品房买卖合同案,因为该案商品房买卖合同中约定的交房条件涉及行政法律关系,而变得相对复杂。要解决该民事法律纠纷,除了要分析当事人之间的民事法律关系,还必须分析案涉行政法律关系,必须对行政法有关行政备案、行政委托、责令改正、行民交织等理论分别进行分析论证,从而为最终解决行民交织类案件提供一定的理论和技术支持。随着我国《民法典》的颁布,在这样一个公私法融合的时代,现代行政法将进一步影响民法的发展,同时,其自身也会受到民法的“感化”,平等、自由等民法理念将让行政法变得更加柔软。

In Modern Society there are more and more administrative services mixingwith civil juristic acts and rights when administrative subjects manage state affairs.This case Mr.Wang V.Sichuan Hongtian Real Estate Company is a relatively complex case of contract for sale of commodity house because the agreed conditions of the commercial housing sale contract involved in the administrative legal relationship.In order to solve the legal disputes of the contract it is necessary to analyze not only the legal relationship between the parties but also the administrative legal relationship.To analyze this case we must analyze and judge the relevant legal issues one by one so as to provide theoretical and technical support for the final settlement of the legal disputes in this case.With the promulgation of the Civil Code modern administrative law will furtheraffect the development of civil law.At the same time the administrative law itself will be“influenced”by the civil law.
