“Problems of China” in the Implementation of Investor Protection Mechanism from the New Securities Law

我国于2019年年底新修订了《证券法》,该修订突出强调对投资者合法权益的保护。自2020年3月1日该新法施行以来,资本市场出现一系列相关案件,引起了学界和业界的热烈讨论;其中,投资者保护的相关问题尤其引人注目。在投资者保护机制公共执法(public enforcement)和私人执法(private enforcement)的有机平衡上,我国新《证券法》的实施既体现了全球资本市场所面临的相似挑战,也反映出了我国资本市场特有的问题。在此,本刊聚焦于新《证券法》投资者保护机制实施的"中国问题",组织相关学者就这些问题展开探讨,形成本组笔谈,以期能够有助于推进对新《证券法》中投资者保护机制实施的思考和研究,有助于资本市场的行稳致远。另外,本次四篇稿件按照作者姓氏拼音排序。

China revised the Securities Law at the end of 2019,which particularly emphasized the protection of investors’legitimate rights and interests.Since the implementation of the new law on March 1,2020,a series of cases have appeared in the capital market.The academic and the industry have had a heated discussion on these cases,among which the related issues of investor protection are particularly noticeable.Regarding a balance between public enforcement and private enforcement of investor protection mechanism,the implementation of China’s new Securities Law not only reflects the similar challenges faced by the global capital market,but also reflects the unique problems and concerns of China’s capital market.Here,we pay attention to the"Problems of China"in the implementation of the investor protection mechanism from the new Securities Law and organize these papers to discuss these problems.By doing so,we aim to help promote the analysis and research on the implementation of the investor protection mechanism in the new Securities Law and benefit the stability of the capital market.
