The commercial application of health and medical data is the driving force of innovation in China’s deepening market reform,and it is a concrete manifestation of the deep integration of the digital economy and the real economy,creating a full value chain of medical data.It is a process of balancing the rights and interests of multiple data subjects during the data collection,processing and use stages.At present,China does not have a special law to regulate the commercial use of medical data.Therefore,in the absence of industry self-discipline and legal supervision,it has caused practical problems such as the risk of personal information exposure and the irregular use of medical data.Based on the characteristics of medical data,it is necessary to improve relevant legal protections,appropriately expand the“informed consent”of the original data subject,and establish a supervisory coordination mechanism based on“industry self-discipline+government regulation”.This is the basic guarantee for the commercial application of health and medical data,and also the fundamental way for the long-term development of data market.
