Prevention of Infringement by the Application of Face Recognition Technology in Railway Passenger Transport

为了更好地防范人脸识别技术的侵权风险,保护公民权利,通过文献研究、案例分析、专家咨询和实地调研等方法,阐述铁路客运应用人脸识别技术可能引发的侵权风险,分析目前铁路客运对人脸识别技术的具体应用,提出健全完善法律制度、加强现有法律的实施、重视司法引导、强化行业自律、利用技术支撑等铁路客运应用人脸识别技术防范侵权的对策,以期合法合理应用人脸识别技术,做到既避免侵犯公民权利,又充分发挥新技术的优势,保持新技术发展应用和权利保护之间的平衡,促进国家利益、企业利益和个人利益的共同实现。

To prevent infringement by the face recognition technology and protect the rights of citizens, this paper described the risk of infringement caused by the technology and analyzed its specific applications in railway passenger transport through literature research, case analysis, expert consultation, field research and other methods. The countermeasures such as perfecting the legal system, strengthening the implementation of existing laws, stressing judicial guidance, strengthening industry self-regulation, and seeking technical support were proposed to prevent infringement by the face recognition technology in railway passenger transport. Those measures aim to legally and reasonably apply the face recognition technology by avoiding the infringement of civil rights while giving full play to the advantages of new technologies, thereby maintaining the balance between the protection of rights and the development and application of new technologies and promoting the coordination among national interests, enterprise interests and personal interests.
