检察公益诉讼案件范围拓展研究

国家和人民利益高于一切。党的十九届四中全会《决定》为检察公益诉讼案件范围的拓展提供了根本遵循与行动指南。拥有公共利益代表和国家法律监督机关双重角色定位属性的检察机关,在当前防范化解重大风险、推进国家治理体系和治理能力现代化的大背景下,应结合五年以来的司法实践经验,积极稳妥开拓公益诉讼"等外"空间。检察机关在国家和社会治理中扮演至关重要的角色,应注重回答"新题难题",逐渐将公益诉讼范围拓展至专业性技术性更强、影响范围更广、关乎国家持续性发展核心利益和重大社会公共利益,但社会组织力量缺位、监管易于"失序"、政府"失灵"风险较高的关键场域,从深层次、宏观角度做好新时代公益诉讼检察工作,向人民提供更加优质的公益诉讼检察产品。

The interests of the country and the people are above everything else.The Minute of the Fourth Plenary Session of the 19th Central Committee of the Communist Party of China provides the ultimate guidance and basic theoretical standings for the expansion of the scope of public interest litigation filed by people's procuratorate.Under the background of preventing and defusing major risks and promoting the modernization of China's governance system and capacity,and with the dual role positioning attribute of public interest representative and national legal supervision organ,the procuratorial organ should integrate the experience gained in the past five years'judicial practice to actively and steadily expand the"outside"space of public interest litigation.As a key role in national and governance,the procuratorate shall pay attention to solving new and difficult problems,and gradually expand the scope of public interest litigation to the key fields with stronger expertise and technology and a wider sphere of influence that concerns the core interests of the country's sustainable development and major social and public interests,but in these fields the strength of social organizations is absent,regulations are prone to"go out of order",and the risk of government"failure"is high.A good job should be done in the procuratorial work of public interest litigation in the new era from a deep and macro perspective to provide the people with better procuratorial products of public interest litigation.
