我国《草原法》立法问题研究

Research on the Legislation of“Grassland Law”of China

草原作为一种常见的生态环境,随着人类社会的发展和资源的开发不断出现一些生态问题,它的修复离不开环境保护与法制建设。我国《草原法》就是为解决草原资源利用问题而建立的新式立法体系,但随着草原生态环境的恶化现状和人类社会的发展,现行的《草原法》已经无法满足提升草原生态环境的要求。所以,应从我国草原资源现状和《草原法》的立法必要性出发,对《草原法》诸项立法问题和立法意蕴展开深度研究,不仅对我国《草原法》立法内容的进一步完善具有理论意义,也对我国农牧民在制衡草原生态环境的基础上更大程度地发挥草原资源的效益具有实践意义。

Grassland is a common ecological environment.With the development of human society and re⁃source development,some ecological problems continue to appear.Its restoration cannot be separated from environ⁃mental protection and legal construction.“Grassland Law”is a new legislative system established to solve the prob⁃lem of grassland resource utilization.However,with the deterioration of the grassland ecological environment and the development of human society,the current“Grassland Law”can no longer meet the requirements of improving the grassland ecological environment.Therefore,starting from the current situation of China’s grassland resources and the legislative necessity of the grassland law,the in-depth study of various legislative issues and legislative im⁃plications of the grassland law is not only of theoretical significance to the further improvement of the legislative content of the grassland law,It also has practical significance for farmers and herdsmen to play a greater role in the benefits of grassland resources on the basis of balancing the grassland ecological environment.
