数字经济市场化监管与公平竞争秩序的构建

Market Oriented Supervision of Digital Economy and the Construction of Fair Competition Order

数字技术创新与反垄断之间表面上存在"悖论",但可通过市场化监管取向迎刃而解。建立公平竞争的市场秩序是推动数字经济发展的长效举措。参照近年来的国际通行做法,在辨析有关数字经济发展的几个认知误区的基础上,指出我国数字经济监管应坚持市场化原则,加强对互联网企业反竞争行为本身的认定,以行为为标准、以数据为抓手、以技术创新为导向、以市场公平为底线,重点围绕行业内反垄断、跨行业无序扩张、数据使用公开开放等方面,作出系统性、长效化的制度设计。

On the surface,there is a"paradox"between digital technology innovation and antimonopoly,but it can be solved by market-oriented supervision.Establishing a fair market order is a longterm measure to promote the development of digital economy.Referring to the international practice in recent years,based on the analysis of several cognitive misunderstandings about the development of digital economy,this paper points out that the supervision of digital economy in China should adhere to the principle of marketization,strengthen the identification of anti competitive behavior of internet enterprises,take behavior as the standard,take data as the starting point,take technological innovation as the guidance,take market fairness as the bottom line,and focus on the anti-monopoly within the industry,cross industry disorderly expansion,open and open data use and other aspects,make a systematic and long-term system design.
