我国亚太相关自贸区涉海原产地规则的缺陷与完善

Defects and Improvement of the Maritime Rules of Origin in China’s Asia-Pacific Free Trade Zones

海洋资源是国家战略资源的重要基地,而我国在参与制定亚太相关自贸区原产地规则时缺乏对海产品、矿产品等涉海原产地判定标准的系统性思考和研究,为此本文分析了目前我国亚太相关自贸区涉海原产地规则的缺陷,以期为我国利用原产地规则来维护海洋权益和填补立法空白提出相关对策建议。

Marine resources are the important bases of national strategic resources.China lacks systematic thinking and research on the criteria for judging sea origin of marine products and mineral products when participating in the formulation of rules of origin of relevant Asia-Pacific free trade zones.Therefore,this paper analyzes the defects of the rules of origin of China’s Asia-Pacific free trade zones,with the purpose of providing some suggestions for China to use the rules of origin to protect the rights and interests of the ocean and fill in the legislative gaps.
