网络非法野生动物交易现状研究——以2015—2019年已决刑事案件为研究对象

Research on the Current Status of Illegal Wildlife Trade on the Internet Platform:Based on the Executed Criminal Cases Between 2015 and 2019

为探索近年来我国网络平台中非法野生动物交易现状,以中国裁判文书网2015—2019年相关一审案件为研究对象,发现我国非法野生动物交易网络化趋势显著,依托网络平台实施犯罪已成为主流方式,表现出犯罪行为模式化、犯罪地区聚合化、犯罪平台分工化的特点。治理此类犯罪面临的主要困境包括网络广告数量巨大成为灰色地带、网络暗语形式多样躲避监管、暗网涌动提供新型犯罪平台。据此提出以多维主体合作实现网络监管技术升级为主,同时兼顾犯罪打击前置以及公众健康消费观培育的治理方案,从人防、技防、意防实现全面打击。

Based on the crime cases between 2015 and 2019 on China Judicial Documents Network,this study explored the current status of illegal wildlife trade on the internet platform.The results showed that illegal wildlife trade has shown an obvious web-based trend in China,and mainly depends on the network platform.The crimes are normally characterized as modelling behavior,collective region,and divided and cooperative platforms.The major challenges found in countering cyber illegal wildlife trade are the large number of advertisements on social platforms,the diverse code words,and the dark websites.Additionally,the countering strategies should focus on developing the network monitoring technology through the cooperation between multiple bodies,advancing crime prevention,and raising the public health consumption views.This study contributes to build an integrative system of civil,technological,and conscious precaution.
