区块链智能合约应用于著作权集体管理制度的设想与路径

现阶段的著作权集体管理组织模式已无法适应数字时代下著作利用型态,还存在支付权利金的流程庞杂且容易被中间人隐匿、音乐创作人难以及时获取应得合理报酬等现实困境。应用区块链技术后,能够有效解决著作权集权管理组织所面临的无法处理的身份验证问题,赋予著作权利人通过智能合约进行授权管理的自主控制权,协助著作权集管组织建立全球资料大数据库。区块链技术是否适应于著作授权,应视著作授权的目的及方法、范围来决定,如果是特定目的、一次性授权金额高的大权利授权,为使授权的目的、范围、内容和授权金明确化,权利人和使用人之间可以选择区块链和智能合约来辅助授权。

The current organization mode of collective management of copyrights,has been unable to adapt to the use of massive works in the digital era,and there are many complicated processes of paying royalties which can be easily hidden by the middlemen,and it is difficult for music creators to obtain reasonable remuneration in time.The application of blockchain technology can effectively solve the problem of identity verification that can not be handled by the copyrights collection and management organization,endow the copyrights owners with the independence right to authorize management through the smart contract,and assist the copyrights collection and management organization to establish a global data base.Whether blockchain technology is suitable for copyrights licensing depends on the purpose,method and scope of copyrights licensing.If it is a specific one-time right licensing that involves a large sum of money,the copyrights holder and the user can naturally choose blockchain and smart contracts to assist licensing in order to make the purpose,scope,content and licensing fee clear.
