摘要
为了填补滥用基因编辑技术的立法空白,《刑法修正案(十一)》第39条增设了“非法植入基因编辑、克隆胚胎罪”。本罪有着鲜明的预防刑法色彩,是行政违法行为的犯罪化,保护的法益是人类基因科学技术应用过程中的伦理性和安全性。本罪的处罚必须达到“情节严重”,由于“情节严重”属于违法构成要件要素,其内容必须是反映法益侵害程度的客观要素。本罪在立法层面尚有不足,应当通过补充行为类型、增设单位犯罪主体和健全前置性行政法律规范来完善。
In order to fill the legislative gap of gene editing abuse,Article 39 of Criminal Law Amendment(11)added the crime of “illegally planting gene edited and cloned embryo”.This crime has a distinct color of preventive criminal law,which is the criminalization of administrative violations,and the legal interest protected is the ethics and safety in the application of human gene science and technology.The punishment of this crime must reach “serious circumstances”,because “serious circumstances”are the elements of the illegal constitution,the content of which must be objective elements reflecting the degree of infringement of legal interests.The crime is still insufficient in legislation,and should be improved by supplementing the type of behavior,adding the subject of unit crime and perfecting the pre administrative laws and regulations.
