Guidance and Order: Value Analysis of the Spirit of Civil Law Incorporated into Police Network Literacy

网络社会发展中伴随着价值失守与规则秩序失序状况。警察群体既具有一般参与主体提升网络素养以适应网络化生存的现实需求,也具有警察职责所赋予的网络治理参与的客观必然。在此语境下,民法精神不仅可以给予警察网络素养以观念层面的价值引领,也可以给予规则层面的秩序重构,这需要从分析民法精神融入警察网络素养的现实价值与期待价值等方面获得必然性与应然性的支持。

The development of the network society is accompanied by the loss of value and the disorder of rules. The police not only have the actual needs that the general participants to improve the network literacy to adapt to the networked survival, but also have the objective necessity of participating in network governance given by the police’s responsibilities. In this context, the spirit of civil law can give the police network literacy a value guide at the conceptual level, and it can also restructure the order at the rule level. This requires inevitability and ought to be supported from the analysis of the actual value and expected value of the Civil Law spirit into the police network literacy.
