多元解纷机制下劳动争议调解员专业化之探讨

我国多元解纷机制改革下劳动争议调解员专业化问题突出。调解员在调解活动中发挥主导作用,这决定了调解员专业化之实质是调解专业化,调解员专业化应当符合调解专业化的具体要求。我国调解制度及规范决定了专业化调解员应当具备一定法律知识和调解技能、立场中立、完成了调解员资格认证程序。多元解纷机制下我国劳动争议调解面临着"高调解率"、源头治理、有效分流的压力,同时劳动争议调解具有限度要求、利益事项调整等特殊性,使得劳动争议调解员专业化更为重要、紧迫。因此,应当通过构建劳动争议调解员或调解员资格管理制度、调解员行为监管及试行专业劳动争议调解服务市场化,逐步实现劳动争议调解员专业化。

At the same time, labor dispute mediation has specific requirements such as limited requirements and adjustment of interests, which makes the professionalization of labor dispute mediators more important. Therefore, it is necessary to gradually realize the professionalization of labor dispute mediators, through establishing labor dispute mediator or mediator qualification management system, mediator behavior supervision and trial implementation of the marketization of professional labor dispute mediation services.
