中国共产党保证执法的实践逻辑——以行政执法体制改革为视角

The Practical Logic of the Communist Party of China’s Guarantee of Law Enforcement:From the Perspective of Administrative Law Enforcement System Reform

领导立法、保证执法、支持司法、带头守法,是中国共产党依法执政、全面推进依法治国战略的基本方式。行政执法是党领导建设法治国家、依法执政的重要环节。在我国行政执法体制发展过程中,应当理顺党的领导和行政执法权力运行的关系。总结中国共产党保证执法的实践经验,以合理配置行政执法权、优化行政权力结构、整合“碎片化”的政府功能、提升行政效率作为行政执法体制改革的基本目标。按照“社会发展—功能变迁—结构调整”的路径,在厘清中央与地方、同级职能部门事权界限的基础上,依照事权相对集中、权责对等的原则,根据不同层级政府和职能部门的事权范围,明确其执法权限,合理配置执法力量,并以法律的形式最终确定,从而实现党保证执法的科学化、规范化、法治化。

Leading legislation,ensuring law enforcement,supporting the administration of justice,and taking the lead in abiding by the law are the basic ways for the Party to govern in accordance with the law and comprehensively promote the strategy of rule of law.Administrative law enforcement is an important part of the Party’s leadership in building a country under the rule of law and governing in accordance with the law,which makes it necessary to rationalize the relationship between the leadership of the Party and the operation of administrative law enforcement power in the background of the evolution of China’s administrative law enforcement system.Based on this understanding,it’s necessary to summarize the Communist Party of China’s practical experience in guaranteeing law enforcement and set the basic goal of the reform of administrative law enforcement system as rationally allocating administrative law enforcement power,optimizing the allocation of administrative power structure,integrating“fragmented”government functions and improving administrative efficiency.Besides,the law enforcement authority should be clearly defined and the law enforcement force should be rationally allocated in such a way as following the path of“social development-functional change-structural adjustment”according to the scope of the power of different levels of government and functional departments in accordance with the principle of relative centralization of power and the principle of equal power and responsibility.The results of the law enforcement authority definition and the law enforcement force determination will finally be solidified in the form of law,so as to realize the effect of the Party-guaranteed scientific,standardized and legalized law enforcement.
