Implementing Xi Jinping's Thought of Rule by Law and Promoting the Reform of Sports Administrative Law Enforcement:Interpretation of the Opinions on Further Standardizing and Strengthening Local Sports Administrative Law Enforcement

采用文献资料法、内容分析法等,从理念、体制、程序、保障、监督五个层面对《关于进一步规范和加强地方体育行政执法工作的若干意见》进行解读,重点阐述执法体制中委托行政执法的路径与方式,并对法条中“责令改正”“违法所得”等重点内容的适用进行界定与分析。提出深入推进体育行政执法机制改革:提高认识,转变体育行政执法理念;权责明晰,完善体育行政执法体制;规范执法,强化体育行政执法程序意识;强化保障,提升体育行政执法能力;监督到位,明确体育行政执法责任。

The article interprets the Opinions on Further Standardizing and Strengthening Local Sports Administrative Law Enforcement from the fi ve aspects:concept,system,procedure,guarantee and supervision,by using the methods of literature review and content analysis.It focuses on the path and method of entrusted administrative law enforcement in the system,as well as the application of"ordering to correct"and"illegal income"in the rules.The reform of sports administrative law enforcement should be promoted by five parts as follows:improving the understanding,changing the concept of sports administrative law enforcement;clearing rights and responsibilities,perfecting the sports administrative law enforcement system;standardizing law enforcement,strengthening the consciousness of sports law enforcement procedure;strengthening the guarantee,improving the ability of sports law enforcement;supervision in place,clearing sports law enforcement responsibility.
