电商平台“二选一”行为的反垄断法规制研究

Research on Antimonopoly Law Regulation of"Pick One of Two"Behavior of E-commerce Platform

电商平台“二选一”行为虽能有效解决搭便车的问题,但也会产生排斥、限制竞争的后果,从而导致消费者福利的损害和市场创新的抑制。考虑到我国电商平台市场已存在高度的集中、“二选一”行为的泛滥和规制力度较弱的现状,应当强化对“二选一”行为的规制。因为“二选一”行为的本质仍是一个垄断问题,其行为结果亦是一种垄断后果,因此应当以《反垄断法》的规制为主。结合已有的国内外研究和规制经验,应当从强化执法力量、优化市场地位认定、强调豁免比例原则等三个方面对电商平台“二选一”行为的反垄断规制予以完善。

Although the"pick one of two"behavior of e-commerce platform can effectively solve the problem of free rider,it will also produce the consequences of exclusion and restriction of competition,which will lead to the damage of consumer welfare and the inhibition of market innovation.Considering the current situation of high concentration,the flood of"pick one of two"behavior and weak regulation in China's e-commerce platform market,the regulation of"pick one of two"behavior should be strengthened.Because the essence of the"pick one of two"behavior is still a monopoly problem,the result of the behavior is also a monopoly consequence,so it should be regulated mainly by the anti-monopoly law.Combined with the existing research and regulatory experience at home and abroad,it is necessary to improve the anti-monopoly regulation of"pick one of two"behavior of e-commerce platforms from three aspects:strengthening law enforcement,optimizing the identification of market position,and emphasizing the principle of exemption ratio.
