摘要
近几年,网络直播依托于互联网的发展迅速崛起,网络主播作为新兴行业也逐渐进入大家的视野。为寻求自身发展,网络主播纷纷选择与多频道网络(MCN)机构进行签约。但在立法上对于MCN机构和主播之间的法律关系尚未有明确的认定标准,在实践中也存在多种情况通常难以认定为劳动关系,因此网络主播通常不能得到劳动法的保护。对此,我国应当引入非标准劳动关系,建立多层次的分类保护机制;制定下位法,对网络用工关系进行规制;同时,司法裁判中也应当认识到此类新型用工形式的特殊性,转变唯“从属性”的观念。
In recent years,the network live broadcasting is growing up rapidly relying on the development of the Internet.As an emerging industry,network anchor has gradually entered the field of vision.In order to seek their own development,they have chosen to sign contracts with MCN institutions.However,in legislation,there is no clear standard to identify the legal relationship between MCN agencies and anchors;in practice,there are many situations that can hardly be identified as labor relations,so network anchors rarely get the protection of labor law.In this regard,China should introduce non-standard labor relations,establish a multi-level classified protection mechanism,formulate a lower law to regulate the network employment relations;at the same time,the judicial adjudication should also recognize the particularity of this new form of employment,and change the concept of"subordination".
