摘要 社区团购平台"以量定采、多级仓储"的商业模式,结合互联网巨头企业自身的信息优势以及多边市场跨界竞争等特征,可能会导致以低价倾销、平台二选一、大数据"杀熟"、阻碍市场信息流通以及预防性并购为代表的滥用市场支配地位与经营者集中等垄断行为。在此基础上,通过利用反向推演法代替传统SSNIP测试法,将滥用市场支配力扩张解释为滥用市场支配地位及滥用相对市场支配地位以及将是否限制创新作为经营者集中的申报条件、将信息控制增设为经营者集中的情形之一,最终使得我国《反垄断法》可以有效规制社区团购中出现的垄断行为。 Community group-buying platform,"basing purchase on sales,multistage storage"as a measure of the business model of combining Internet giant information superiority of the enterprise itself and multilateral crossover market competition and so on characteristics,can lead to dumping at a low price,unreasonable trading conditions on the platform,big data price discrimination,hinder the circulation of market information,as well as preventive merger of abuse of dominant market position and concentration of monopoly.On this basis,the traditional SSNIP test was replaced by the reverse deduction method.To abuse market power expansion explanation for the abuse of dominant market position and relative abuse dominant market position and limit whether innovation as a declaration of concentration condition,control to add the information for the concentration of circumstances,led to the anti-monopoly law in China can effectively regulate monopoly behavior in group-buying community.
