城市发展背景下古建筑保护的法律对策研究

Research on the Legal Countermeasures for the Conservation of Ancient Buildings in the Context of Urban Development

随着城镇化建设和经济社会发展,城市中古建筑的保护问题及其研究进入了新阶段。法律作为一种制度保障,可以起到界定、规范、引导古建筑保护具体行为活动的作用。本文讨论了当前古建筑保护现状和形势、我国整体的古建筑保护法律体系及相关法律的适用困境,提出了古建筑保护的法律对策及建议,探索以法律手段推动古建筑保护的新局面。

With the urbanization construction and economic and social development,the protection of ancient buildings in cities and its research have entered a new stage.As a kind of institutional guarantee,law can play a role in defining,standardizing and guiding the specific activities of conservation of ancient buildings.This paper discusses the current situation of the conservation of ancient buildings,the overall legal system of the conservation of ancient buildings in China and the dilemma of legal applications,and then puts forward the legal countermeasures and suggestions for the conservation,exploring a new situation of promoting the conservation of ancient buildings by legal means.
