高校图书馆数据库采购谈判中涉及的法律法规问题刍议

A Discussion on the Issue of University Library Database Acquisitionfrom the Perspective of Laws and Regulations

以数据库为代表的电子资源已经成为图书馆馆藏资源建设的重要组成部分。数据库的采购问题不仅涉及金额巨大,且法律问题复杂。现行高校图书馆采购工作多通过经验思维和行业惯例与数据库供应商进行谈判,鲜有从法律法规的角度认识数据库的采购问题。文章旨在为高校图书馆数据库采购谈判工作提供法理阐释,在运用法律意识和思维规避法律风险的同时,最大限度地争取图书馆和读者的合法权益。文章采用调研分析法、案例分析法,结合当前疫情的实际情况,对图书馆数据库采购过程中的典型案例和瓶颈问题进行调研和整理,提出在我国现有的法律体系框架下解决这些问题的思路与方法。恰当运用相应的法律法规可以为数据库采购谈判提供合理依据,图书馆应通过加强采购馆员法律素养培训,征求法律专家意见等举措,提升数据库采购过程中处理相关问题的法律意识和能力。

Electronic resources represented by databases have become an important part of library collection development.Database acquisition involves not only huge amounts of library budget but also complicated legal issues.Negotiation with database vendors mainly based on inherent experiences and industry practice is usually the way of current databases acquisition of university libraries,while understanding of database acquisition issues from legal perspective is rather rare.Based on this,the article aims to provide a reference for library database acquisition,arouse the legal consciousness of librarians,and use legal weapons and legal thinking to avoid legal risks,while striving for the interests of libraries and readers to the greatest extent.It uses methods of survey and case analysis to investigate typical cases and identify bottlenecks in the library database acquisition process,and points out the methods to solve these problems under the existing legal system framework in our country.By strengthening the legal literacy training of acquisition librarians,and soliciting opinions from legal experts,we hope to improve the library s awareness and ability to handle legal issues in the database acquisition.
