精神赡养义务及履行困境的法律应对

Spiritual Support Obligation and the Legal Countermeasures to the Difficulties of Its Fulfillment

虽然我国《老年人权益保障法》第18条将精神赡养义务入法,但是精神赡养义务的履行仍受到孝道理念的淡化、立法技术的缺陷、司法救济的不能三个方面阻碍,应从契合“义务德性”的方式引导、建构“多方参与”的履行机制、拟合“亲情裂痕”的司法救济三个方面走出精神赡养义务的履行困境。

Although the Article 18 of The Law of the People’s Republic of China on the Protection of the Rights and Interests of the Elderly has incorporated the obligation of spiritual support into the law,the fulfillment of the obligation of spiritual support is still hindered by three aspects:the dilution of the concept of filial piety,the defects of legislative mechanism,and the inability of judicial relief.To address the obstacles,we should guide the fulfillment of the obligation in accordance with the virtue of obligation,construct the fulfillment mechanism with multi-party participation,and adopt judicial relief to fit the“family rift”.
