试论法治视阙下社会征信体系的构建

法治社会的征信体系构建,是基于依法治国的前提下,对社会的整体信用评价进行等级划分。“诚信”一词自古以来,就始终存在于中华民族的多种历史形态中,从个人的道德素养演变成约定成俗的社会共识,但始终缺乏科学的规范性。失信行为的惩戒仅限于道德层面,难以产生一定的威慑力。新时期社会主义建设过程中,“依法治国”理念被多次提及,而信用二字也不再是仅仅脱离法律之外的行为准则,做到法制与道德的有机融合,是推动文明社会进程的关键。

The construction of the credit investigation system in a society ruled by law is based on the premise of ruling the country according to law,which classifies the overall credit evaluation of the society.The word“honesty”has always existed in various historical forms of the Chinese nation since ancient times.It has evolved from personal moral accomplishment into a common social consensus,but it has always lacked scientific standardization.The punishment for dishonesty behavior is limited to the moral level,which is difficult to produce a certain deterrent.In the process of socialist construction in the new era,the idea of“ruling the country by law”has been mentioned many times,and the word“credit”is no longer just a code of conduct that breaks away from the law.It is the key to promote the process of civilized society to achieve the organic integration of legal system and morality.
