价值导向影响案件事实的认定、法律规范的选择以及具体法律方法的运用,法官价值决策的评价标准不是真假与否,而是恰当与否。解决司法适用的价值选择难题,需要以语言分析为切入点,将价值命题要素与其话语功能进行综合分析,进而呈现其主观性与客观性、相对性与一定程度共识性、合规律性与合目的性的内在规定性,凸显出以一种"大逻辑观"视角建立专门司法价值逻辑研究的现实必要性。

Value orientation affects the determination of case facts,the choice of legal norms,and the application of specific legal methods.The evaluation criteria of judges'value decisions are not true or false,but appropriate.To solve the problem of value selection in judicial application,it is necessary to take linguistic analysis as the starting point to comprehensively analyze the value proposition elements and their discourse function,and then present its subjectivity and objectivity,relativity and a certain degree of consensus,regularity and purpose.The inherent stipulation highlights the practical necessity of establishing specialized research on the logic of judicial value from the perspective of a"big logical view".
