The Problems and Countermeasures of the Technical Investigator System

技术调查官制度作为一种新型的应用于知识产权类案件诉讼的技术事实查明制度,在现有的司法实践中起着重要的作用。但是,由于其建立的时间较短,仍存在一定的不足,需要进一步完善。本文首先分析技术调查官产生的背景及其优势,然后探讨我国技术调查官存在的问题,最后提出解决相关问题的对策,以期为我国技术调查官的发展提供参考。

As a new technology fact finding system applied in intellectual property litigation,technology investigator system plays an important role in the existing judicial practice.However,due to its short establishment time,there are still some shortcomings,which need to be further improved.This paper first analyzed the background and advantages of technical investigators,then discussed the existing problems of technical investigators in China,and finally put forward the countermeasures to solve the related problems,in order to provide reference for the development of technical investigators in China.
