摘要
虽然我国立法和审判实践中没有规定和先例,但承认无因管理人请求报酬的权利在现今社会经济高速发展的状况下是大势所趋。确保无因管理人有权请求报酬是平衡无因管理人和被管理人间权利义务的体现;是社会救助制度发展至今的需要;也符合社会学中对人性本质的认知,避免了法律以过高的道德标准要求管理人,最终无法实现无因管理制度目的。通过对条文的解释,将无因管理人的报酬纳入必要费用的范畴,以《民法典》第979条作为请求权基础,是报酬请求权比较符合我国立法和司法实践现状的实现方式。
Although there are no regulations and precedents in our country’s legislation and judicial practice, it is the general trend to recognize the right of the manager to ask for compensation without cause under the current situation of rapid social and economic development. Ensuring that the manager has the right to ask for compensation is the embodiment of balancing the rights and obligations between the manager and the managed;It is the need of the development of social assistance system;It also accords with the cognition of the nature of human nature in sociology, and avoids that the law requires the manager with too high moral standards, and ultimately can not achieve the purpose of management system without cause. Through the interpretation of the articles, the compensation of the manager without cause should be included in the scope of necessary expenses. Taking the article 979 of the Civil Code as the basis of the right of claim is a way to realize the right of claim for compensation, which is more in line with the current situation of China’s legislation and judicial practice.
