Common Problems and Individual Issues in Medical Technical Service Contracts in Cancer Specialized Hospital

[目的]分析肿瘤专科医院医学科研技术服务合同中存在的共性问题,以及不同类型技术服务合同存在的个性问题,以便对科研技术服务合同的管理提供精准化对策和建议。[方法]对中国医学科学院肿瘤医院2018—2019年358份第一版医学科研技术服务合同进行统计分析与归纳总结。[结果]技术服务合同中存在较为普遍的共性问题:标的内容、范围和要求不清晰(164/358,45.81%),价款和支付方式不清晰(124/358,34.64%),技术情况和资料保密未明确(107/358,29.88%),技术成果归属和收益不清晰(107/358,29.88%)等。测序服务、技术开发、数据处理、统计分析、建模型、现场数据采集、信息平台搭建等类型的技术服务合同存在各自不同的个性化问题。[结论]管理部门应采取针对性的措施,加强科研技术服务合同管理,加强宣传与培训,增强合同管理信息化建设,建立技术服务合同模板,在合同中增加关于人类遗传资源、医学伦理和廉洁等条款。

[Purpose] To analyze the common problems and individual issues in medical technical service contracts of cancer specialized hospital. [Methods] The first edition of 358 medical technical service contracts in Cancer Hospital, Chinese Academy of Medical Sciences and Peking Union Medical College from 2018 to 2019 were reviewed, and the common problems and individual issues in the contracts were analyzed. [Results] There were common problems in these technical service contracts, including unclear subject content and requirements(164/358, 45.81%), unclear price and payment methods(124/358,34.64%), unclear technical conditions and information confidentiality(107/358,29.88%), unclear ownership and income distribution of technical achievements(107/358,29.88%), etc. The individual problems appeared in different technical service contracts,which were involved in sequencing services, technical services, data processing, statistical analysis, model building, on-site data collection and information platform construction, etc. [Conclusion] The administrative department in the hospital should strengthen the management of scientific research and technical service contracts, including conducting promotion and training, improving the information construction of contract management, developing technical service contract templates;and also need to add information about human genetic resources, medical ethics and incorruptibility in the contract.
