"隐蔽性证据"具有较强的证明力,对隐蔽性证据的研究有助于指引司法实践中收集、运用该类证据,充分发挥隐蔽性证据的证明作用。在现有文献研究的基础上,厘清隐蔽性证据与隐蔽性信息之间的关系,正确界定隐蔽性证据的内涵,归纳出隐蔽性证据的特点,论证了隐蔽性证据对案件证明的方式是验证的证明方式。以"排除被告人虚假的有罪陈述"取代"排除串供、逼供、诱供"表述,可以涵盖更多非作案人知悉隐蔽性证据的情形并消除逻辑上存在的错误,更好发挥隐蔽性证据规定的规范作用。

"Hidden evidence" has a probative force of evidence.The study of hidden evidence is helpful to guide the collections and applications of this kind of evidence in the judicial practice and it provides opportunities to the role of the proof of hidden evidence.On the basis of literature research,the relationship between hidden evidence and hidden information is clarified.The connotation of hidden evidence is correctly defined,and the characteristics of hidden evidence are summarized.It is proved that the way of the proof of hidden evidence is a method of verification.Substituting "excluding false guilty statement of the defendant" for "eliminating collusive confession,coercing confession and inducing confession" can cover more situations where the non-perpetrator knows the hidden evidence and eliminates logical errors in order to practice the rules the hidden evidence better.
