摘要
采用负面清单对跨境服务贸易进行管理已成为全球的发展趋势。中国将尝试在中韩FTA、中澳FTA中采用负面清单对跨境服务贸易进行管理,未来在双边、多边区域贸易协定中采用负面清单进行谈判也是必然之势。CPTPP代表了全球投资贸易规则的高水平实践,本文分析了CPTPP跨境服务贸易部分的内容以及成员国在附件Ⅰ、附件Ⅱ中负面清单的具体内容,从限制措施的数量、格式规范、领域分布、违背的正面义务等方面对CPTPP成员国负面清单的特征进行分类总结,进而结合中国的负面清单实践,从加快转变跨境服务贸易管理思路、熟练运用两类负面清单的服务贸易管理模式以及负面清单领域设计更具科学性的角度提出建议。
The use of negative lists to manage cross-border service trade has become a global development trend. China will adopt a negative list in the China-South Korea FTA and the China-Australia FTA to manage cross-border trade in services. It is also inevitable that the negative list will be used for negotiation in bilateral and multilateral regional trade agreements in the future. CPTPP represents the high-level practice of global investment and trade rules. This article analyzes the content of the cross-border service trade part of CPTPP and the specific content of the negative lists of member states in Annex Ⅰ and Annex Ⅱ, from the number of restrictive measures, format specifications, and field distribution, Violation of positive obligations, classify and summarize the characteristics of the negative list of CPTPP member countries, and then combine with China’s negative list practice, from accelerating the transformation of cross-border service trade management thinking, accelerating the standardization of negative list format and design of the negative list field Make recommendations from a more scientific perspective.
