“一带一路”视域下中国国际法治话语权的建构与提升

Construction and Promotion of China’s Discourse Power of International Rule of Law under One Belt and One Road Initiative

在国际社会交往中,普适的“国际法治”话语具备强大的感召力,能够缔造强大的话语平台、提出先进国际法治理念的国家将会占据话语优势、掌握话语权,对全球治理产生深刻影响。历史上,我国曾提出过“和平共处五项原则”等广受欢迎的中国国际法治理念,过去8年的“一带一路”建设也促进了国际规则的公平适用与互联互通,亚投行等新型国际组织的建立更集中彰显了中国的国际法治贡献。然而,我国的国际法治话语构建仍然面临话语主体单一、国际司法话语阐释不足、东西方人权话语冲突严重等挑战,需要我国采取有力措施,丰富“一带一路”智库合作网络的国际法治话语供给,拓展“一带一路”争端解决机制的适用领域,推动“发展权”理念的传播与创新,不断增进中国国际法治话语的认同感与影响力,进一步助力中国国际法治话语权的提升。

In international social interactions,the universal discourse of"international rule of law"has a strong appeal.Countries which can create a strong discourse platform and put forward advanced concepts of international rule of law can occupy the discourse advantage,master the discourse right and have a profound impact on global governance.In history,China put forward popular concepts of international rule of law,such as the Five Principles of Peaceful Coexistence.The construction of the"One Belt and One Road"in the past eight years has also promoted the fair application and connectivity of international rules.The establishment of new international organizations such as the Asian Infrastructure Investment Bank(AIIB)has more fully demonstrated China's contribution to international rule of law.Our discourse construction of international rule of law,however,are still facing the challenges of single subject of discourse,insufficient interpretation of international judicial discourse,and a serious conflict between the eastern and western human rights discourse.Our country need take effective measures to enrich the"One Belt and One Road"think tank cooperation network of international rule of law discourse supply,expand the applicable fields of the"One Belt and One Road"dispute settlement mechanism,promote the dissemination and innovation of the concept of"the right to development",continuously enhance the sense of identity and influence of China's international rule of law discourse and further help enhance the discourse power of China's international rule of law.
