随着“一带一路”倡议的持续推进,我国对外承包企业迎来了新的发展机遇,但也面临着贯穿国际工程始终的诸多风险和挑战,而风险的前期识别和管控成为项目顺利实施的重要保证。工程承包合同条款作为国际工程项目的核心文件和项目实施的最高准则,是项目风险早期管控和事前防范的关键环节。本文将对国际承包工程的典型合同条款风险及管控措施进行初步分析和探讨。

Along with the continuous implementation of OBOR strategy,international contractors in China are now embracing new development opportunities while facing accompanied risks and challenges as well.Consequently to identify and control risks at early stage becomes a key guarantee for the smooth implementation of overseas projects.Contract terms,as the core documentation and norm for the project implementation,is the key link and focus for the early control and prevention of project risks.In this paper,a preliminary analysis and discussion have been given as to the typical contract terms related risks and correspondent control measures for overseas projects.
