《区域全面经济伙伴关系协定》核心数字贸易规则反映了缔约方在数字贸易领域的发展诉求,内容涉及电子商务、金融服务、电信服务、投资和知识产权等领域,旨在确保国家基本安全的前提下推进数字贸易发展。与中国已经签署的自贸协定相比,《区域全面经济伙伴关系协定》数字贸易规则在数据跨境流动、数据本地化等议题方面均有突破。同时,通过与《全面与进步跨太平洋伙伴关系协定》的对比可以看出,二者在覆盖范围和自由化程度方面仍存在差别,《区域全面经济伙伴关系协定》未涉及数字产品的待遇和源代码等问题。在政府层面,《区域全面经济伙伴关系协定》数字贸易规则进一步明确了中国在数字贸易领域的关键诉求,将加强中国与各缔约方之间的数字贸易合作,为构建全球数字贸易规则注入新的活力,有助于各缔约方继续完善国内的数字规则体系。在企业层面,《区域全面经济伙伴关系协定》数字贸易规则为缔约方数字企业发展带来机遇,同时对数字企业的合规体系建设提出了新的要求。

The key digital trade rules of RCEP represent the demands of China and other parties in the development of digital trade,which are mainly reflected in the fields of e-commerce,financial services,telecommunications services,investment and intellectual property rights,aiming to promote digital trade development under the premise of ensuring basic national security.Comparing RCEP with other free trade agreement that China has signed,the content of the key digital trade rules of RCEP has breakthroughs in topics such as cross-border data flow and data localization.At the same time,through comparison with CPTPP,it can be seen that there are still differences in coverage and degree of liberalization.For instance,RCEP does not involve issues such as the treatment of digital products and source code.At the national level,the RCEP digital trade rules further clarify China’s key demands in the field of digital trade,and will strengthen digital trade cooperation between China and other parties,and help continue to improve the domestic digital rule system in each contracting party.At the enterprise level,the RCEP digital trade rules bring the digital enterprises in contracting parties with opportunities;and meanwhile,it imposes new requirements on these digital enterprises in constructing their compliance system.
