量刑公正是形式正义与实质正义的有机统一,是刑罚的统一性与刑罚的个别性的有机统一。量刑公正的实现离不开法官自由裁量权的运用,应该避免恣意性裁量和机械性裁量两个极端。量刑思维的本质是事实判断与价值判断的有机统一,人工智能的算法逻辑决定了其不能独立完成量刑思维的全部过程,人工智能介入量刑的领域是有限度的,不能成为量刑活动的主导。实现人工智能与法官在量刑领域的深度融合,必须遵循人工智能的算法逻辑和量刑运行的基本规律。
